This is a translation for convenience. The German version is the authoritative one, and German law applies.
In one sentence: you may use Aszendra free of charge, as often as you like and on as many of your own devices as you like. You may not sell it, take it apart, or pass it on under another name.
1. Subject
These terms govern the use of the program Aszendra (“the software”) between David Baader (“we”) and you. By installing it you agree to them.
2. Right of use
You receive a simple, non-exclusive, perpetual and free right to install the software on any number of devices and to use it for private and commercial purposes. You may pass on unmodified copies of the original installation files free of charge.
3. Restrictions
You may not:
- sell, rent or sublicense the software;
- modify, reverse-engineer, decompile or disassemble it, except where § 69e of the German Copyright Act expressly permits it;
- remove or alter attributions, trademarks or copyright notices;
- distribute modified versions or versions under another name.
4. Updates
The software may check for a newer version on its own and install it. This can be switched off in settings. The same terms apply to updates. There is no entitlement to updates or to any particular period of operation.
5. No warranty
The software is provided free of charge and without warranty, in particular without any assurance of fitness for a particular purpose, freedom from defects, or uninterrupted availability.
6. Liability
We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For ordinary negligence we are liable only for breach of a material contractual obligation, limited to the foreseeable damage typical for this type of contract. Otherwise liability is excluded. Liability under the German Product Liability Act remains unaffected.
For data loss we are liable only to the extent that you have backed up your data regularly and appropriately. This expressly includes the contents of the password vault: if the master password is lost and no recovery code exists, the contents are technically and finally inaccessible — to us as well.
7. Termination
The right of use ends automatically if you breach section 3. You end it at any time by uninstalling the software.
8. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected. If a provision is invalid, the remaining ones stay in force.
